DATA SUBJECT CONSENT FORM
During your course of your employment with us, we will collect and process your personal data as described below and we seek your consent for such processing.
TYPE OF PERSONAL DATA COLLECTED
We collect the following personal data:
- Full name;
- Identity card or passport number;
- Residential address;
- Mobile number;
- Email address;
- Employee number;
- Nationality;
- Race;
- Religion;
- Gender;
- Academic qualification;
- Statutory file numbers such as EPF, Income Tax, Perkeso file numbers;
- Bank account details;
- Relevant reports of recent health checks (which may qualify as sensitive personal data and is kept strictly confidential);
- Particulars of immediate family members, including full name, identity card number, relationship, mobile number, etc;
- Particulars of parents, parents in law and/or siblings, including full name and contact number; and
- Other information that we will require for the purpose of your employment with us or for the continuation of your dealings with us as part of our business
If you are an employee or potential employee, the personal data requested by us is compulsory. If you do not provide such personal data, we may not be able to continue to employ you or offer an employment position to you.
We may request for other personal data that may be optional; we will indicate such personal data when requesting for it.
SOURCE OF COLLECTION
We collect your personal data from the following sources:
- when you first contact us to apply for employment or an enquiry for business purposes;
- your employment application form;
- recruiters who we appoint or who contact us with your information; and/or
- from you directly in course of your employment.
PURPOSE FOR PERSONAL DATA COLLECTION
We use your personal data for the following purposes:
- to work with you as our employee;
- to undertake human resources and payroll administration;
- to contact you if there is an emergency;
- to assess your health as a suitable employee;
- to contact and communicate with you as part of your employment with us; and
- to improve our business and internal administration.
TRANSFER AND DISCLOSURE OF PERSONAL DATA
We will not transfer or disclose any of your personal data to any third party without your consent, except to our employees, our shareholders, related companies, our affiliates, our business partners, our vendors, our appointed agents, our lawyers, payroll providers, and other service providers, financial institutions and/or insurance companies, within and outside Malaysia, where it is necessary for purposes mentioned in this notice and other related purposes.
We will also disclose and transfer your personal data without your further consent if we are compelled or required under the law to make sure transfers or disclosures.
SECURITY MEASURES
Your personal data is kept secure and confidential. Our security measures to protect your personal data include inter alia the following measures:
- only authorised staff is allowed to access your personal data;
- our system of storing your personal data is encrypted and only accessible by our
authorised staff with their own credentials;
- we have established anti-virus and firewalls to protect your personal data against viruses, malware and data corruption;
our data processors have provided us with guarantees that they have sufficient security measures to protect personal data processed by them on our behalf from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration, or destruction.
UPDATING OF PERSONAL DATA
We are committed in ensuring the confidentiality, protection, security, and accuracy of your personal data made available to us. It is your obligation to ensure that all personal data submitted to us and retained by us are accurate, not misleading, updated and complete in all aspects.
For the avoidance of doubt, we and/or the Group and/or its employees or authorized officers or agents will not be responsible for any personal data submitted by you to us that is inaccurate, misleading, incomplete and not updated.
Further, in the event you disclose personal data that belongs to another data subject for the purposes indicated in this notice, we will require your assistance to procure the consent of such third party data subject or the guardian of such data subject (if they are minors).
RETENTION PERIOD
We will store your personal data in the country in which we are based, i.e. Malaysia. However, we may have back up and storage servers, which are located overseas.
Your personal data will be deleted entirely as soon as it is no longer needed for the specified purposes. However, relevant personal data may be retained subject to the conditions below:
- where we are required to retain information under the law;
- where legal actions have arisen and are pending;
- commercial/operational purposes that continue to exist.
We will take all reasonable steps to ensure that all personal data is destroyed or permanently deleted when no longer required for the purposes indicated in this notice or where personal data is inactive for a continuous period of 7 years.
YOUR RIGHTS
You may at any time after the submission of your personal data to us, submit your request for access to your personal data by submitting such request to us in the event:
- you require access to and/or wish to make corrections or updates to your personal data subject to compliance of such request for access or correction not being refused under the provisions of existing laws;
- you wish to enquire about your personal data; and
you are no longer agreeable to us retaining, holding or storing your personal data. However, please note that this may result in us not being able to properly perform or discharge our obligations to or continue our business or employment relationship with you.
